The principles and functions of local councils are defined by the Local Government Act 2019 (Section 322). One of the key roles of a council is to make informed and responsible decisions that serve the best interests of the community.
Certain decisions made by councils are subject to review. A reviewable decision occurs when a community member presents a substantial reason to the council, prompting an administrative review committee to reevaluate the decision.
Reviewable decisions encompass various situations. For example, a reviewable decision may involve correcting errors in the assessment record, such as an incorrect allotment number, as stated in section 232(1) or 233(7).
A reviewable decision can also include a request to council to reconsider a regulatory order (section 286 of the Act). A regulatory order is an order from council for a community member to take specific action to do something, or stop doing something. An example could be the council issues a regulatory order to a community member, directing them to limit noise levels during specific hours. The community member believes the order is unjustified and requests the council to review and reconsider the decision.
Furthermore, individuals have the right to request the suppression of their personal details from publicly available material by submitting a written request. The council must comply with the request unless it considers there is a good reason for not doing so. A decision to refuse suppression of personal details from publicly available material is reviewable as outlined in section 293(5) of the Act.
